Purposes and legal basis for data processing

We process personal data in accordance with the provisions of the EU General Data Protection Regulation (EU GDPR), the German Federal Data Protection Act (BDSG) and other applicable data protection regulations. Which data specifically is processed in which manner is generally determined by the respective requested and/or the agreed-upon service.

Purposes of performing a contract or of steps prior to entering into a contract (Article 6 (1) b of the GDPR)

Processing of personal data is carried out to perform your orders as well as to perform measures and activities as part of relationships prior to entering into a contract, for example with parties interested in properties. Data processing serves in particular the provision of services according to your orders and wishes and is comprised of the services, measures and activities necessary for this.

Purposes within the framework of your consent Article 6 (1) a of the GDPR)

Within Legat Living GmbH & Co. KG, your data is only made available to the parties that require it for the fulfillment of our contractual and statutory obligations or as part of the processing and execution of our legitimate interest. Your data is only passed on to external parties

  • in conjunction with contract processing (e.g., notary, architects);
  • for the purposes of fulfilling statutory requirements that obligate us to provide information, report or forward data, or if passing on the data is in the public interest;
  • if external service providers process data on our behalf as processors or function transferees (e.g., IT, marketing or sales service providers).

Your data is processed and stored using a brokerage software program.

Otherwise, your data is not passed on to third parties. If we engage service providers as part of order processing, the data may only be processed for this order and is subject to the same security standards we apply.

Personal data

Personal data is information regarding you as a person, including your name, address, telephone number and email address. You are not required to disclose any personal data to use our website. In certain cases, however, we need your name and address along with other information to offer you the service you require.

We collect, process and use personal data only for the purposes of initiating and fulfilling a contract as well as for the preservation of our own legitimate business interests with regard to advising and servicing our customers. Otherwise, we use your voluntarily provided data exclusively for the purpose for which you provided it to us. Erasure of personal data

We process and store your data for the duration of our business relationship. This also includes the initiation of a contract (precontractual legal relationship) and the execution of a contract. In addition, we are subject to various retention and documentation obligations that arise from the German Commercial Code (Handelsgesetzbuch – HGB) and the German Tax Code (Abgabenordnung – AO), among others. The retention and/or documentation periods stipulated therein extend up to ten years beyond the end of the business relationship and/or the precontractual legal relationship. Furthermore, special statutory provisions may require a longer retention period, for example the preservation of evidence as part of legal statutes of limitation. In accordance with sections 195 cf. of the German Civil Code (BGB), the regular statute of limitations is three years; however, statutes of limitations of up to 30 years can be applicable.
If the data is no longer required for the fulfillment of contractual or statutory obligations and rights, it is erased on a regular basis.

Automatically stored nonpersonal data

When you visit our website, we store certain pieces of information for administrative and technical reasons. This includes the type and version of the browser used, date and time the website was accessed and your IP address.

This data is anonymized and only used for statistical purposes and/or to improve our Internet and online services.

Server log files

Server log files are anonymized data that is collected when you access our website. This information does not allow conclusions to be made about you personally but, for technical reasons, it is essential for the delivery and presentation of our content. They also serve our statistical purposes and the continuous optimization of our content. Typical log files include the date and time of access, the amount of data, the browser used to access the website and its version, the operating system used, the domain name of the provider you use, the page from which you accessed our website (referrer URL) and your IP address. SSL encryption

Rejection of advertising emails

We are required to publish our contact information as part of the statutory legal notice obligation. This information is sometimes used by third parties to send unsolicited advertisements and information. We hereby reject any sending of advertising materials of all kinds not expressly authorized by us. Furthermore, we expressly reserve the right to take legal action against the unsolicited sending of advertising materials. This applies in particular to spam email, spam letters and spam faxes. We point out that the unauthorized transmission of advertising materials could be an offense under competition, civil and criminal law. Spam email and spam faxes in particular can lead to significant claims to damages if they disturb business operations by overfilling inboxes or fax machines.

Google AdWords

We use Google AdWords, an online advertising program from Google Inc., on our website. This service makes use of conversion tracking. Google AdWords uses this tool to place a cookie on your computer when you navigate to our website via a Google advertisement. The cookie is no longer valid after 30 days. It is not used for any individual traceability. If you visit our website as a user and the cookie still works, we, along with Google, are able to see that you clicked on the corresponding advertisement and were forwarded to our website. Each Google AdWords customer is assigned a different cookie. Cookies can therefore not be traced via the websites of the AdWords customers. The data collected using the conversion cookies is used to generate conversion statistics for AdWords customers. As a customer, we are thus able to find out the number of total users who responded to our advertisement and were then forwarded to a website that was equipped with a conversion tracking tag. During this process, we do not receive any information with which we could personally identify you as the user. If you object to the tracking process, you can deactivate the Google conversion tracking cookie in your Internet browser. Use of Google Analytics

We use the web analysis service Google Analytics provided by Google Inc. on our website. This service uses cookies. Cookies are text files that are stored on your computer and thus enable your user activity with regard to our website to be analyzed. These servers are generally located in the United States; however, they adhere to agreements on their use in the European Economic Area and truncate your IP address before transmission to the United States. Only in exceptional cases is the IP address transmitted to the United States before being truncated. Google evaluates the transmitted information and, in this context, provides additional services for us as the website operator. The IP address identified is not combined with other Google services.
